RHCP has been accused of plagiarizing Tom Petty's "Mary Jane's Last Dance" for "Dani California" Someone was nice enough to mix the songs, and it's identical. http://www.jared-morris.com/blog/petty.mp3I can't believe this, I refuse to. RHCP has been so original, I won't believe that they stole Tom Petty's music.

Mary Jane's Last Dance doesn't sound anything like Dani California. Mary Jane's Last Dance is way better than Dani California but that's it. RHCP didn't steal the music some idiot is posting rumors and better stop and listen to the entire music. ********..

So what if they are the same rhythms?People through out the history of music have used the same chords over and over again. If you listened, then you would have realized that RHCP had used those chords and notes in different rhythms and in a different tuning(not to mention on a different string).

pop stars do it all the time(Janet Jackson ripped off America, Jessica Simpson ripped off Mellencamp, Rihanna ripped off Soft Cell etc), so why can't the Chilli Peppers? People even rip off their own music (Brittney's "Baby one more time" and "Oops I did it again", or Nirvana's "Smells Like Teen Spirit" and "Rape Me", etc)

Figures. They aren't that original, in my opinion. But I think it's beginning to become a rite of passage for bands to steal other bands' music. How often do you hear a song on the radio that isn't ripped off another band, who potentially stole that song from another band? "Paint it Black" is a good example of this xd I love that song. Stupid mother, she broke my computer's speakers. No more good music crying

No tainting of Dani California is allowed!! gonk It's the one song of theirs that I really like, because it was on the Death Note trailer (which I watched an obscene number of times).

So they sound remotely similar. Big deal. I can't even count how many times I've mistaken one song for another.
I mean, they don't even sound that much alike. Sure, they have the same basic beat, but they're definitely different.
Mary Jane's Last Dance Dani California
It's not that bad. Really. Especially when compared to things like this.
Every Breath You Take - The Police I'll Be Missing You - P.Diddy
Exactly the same. And P.Diddy didn't even have permission to do so until after he'd finished the song. He even copied the freaking lyrics.
"Every breath you take Every move you make Every bond you break Every step you take I'll be watchin' you."
Compared to...
"Every step I take Every move I make Every single day Every time I pray I'll be missin' you."
C'mon.
The bottom line is that it happens. After a certain point, songs are bound to sound similar.

Dude, yes they do sound alike. I was at my friend's and it was my first time hearing Dani California, and I was like "Hey I know this song...'Oh my my, oh hell yes...'" and my friend was like ".....What?"

Rap/hip hop artists often live off other peoples beats. Sampling as it's called is prefectly acceptable as long as you credit the original artist, some royalties may be involved as well.
One of the odder cases was when John Fogerty was sued because his song Old Man Down the Road sounded too much like a CCR song. The thing was that Fogerty wrote the CCR song and fronted the band.

Eh, they kinda have the same rhythm. But I don't think they're similar enough.

Not being unique doesn't mean you're not original.
