whew! *pulls up a barrel, takes a seat and wipes sweat from brow*
ok so i made a lot of phone calls today....i'm feeling much better now. smile this afternoon i went to the loan guy and he was happy to help me out so next week i'll be able to pay off the car with the original place and have enough to get it into the shop and fix whatever's wrong with it. (i'm pretty sure it's a sensor frying out). he's a good guy and he won't screw me over. i've done business with him before and it was always a good experience so......yay!
then i got home and tried legal aid again - low and behold today he was in! the nuts and bolts of the conversation was if they take me to court they're dumb. i can prove my case and if they try to sue me i should just counter for the deposit. even if they win they can't touch my income (social security) so just don't pay it. by the same token though, if i sue them for the deposit they'll just try to counter for the rent/notice thing. he said the deposit is probably only about $400 bucks so it's probably not worth the hassle and even if i win it doesn't mean they'll pay it. so i guess it's a stalemate. if they don't sue me i won't sue them and vice versa. i'm willing to call the deposit a wash unless they're actually dumb enough to bring me to court and if they do lawyer guy is pretty sure i'll win. he also suggested a few options for getting my crp form without having to go through them.
so huzzah! oh and to answer the questions from the last post:
may - you must have some magic fingers because good fortune did smile on me today. smile
gramma - no, it didn't have anything to do with the management company. the loan simply 'matured'. it was supposed to be paid in 5 years no matter what or there'd be a penalty. a few years ago i had to defer my payments, i thought they would just move my end date back (but i would still accrue interest) but that's not how it works with them. so the money they want now is the money i didn't pay during my deferment but because the loan had a time limit i now have a balloon payment to deal with. wink
