It's easily mistaken for a joke, but the observer does not laugh right away. It's up to the observed to determine whether or not the humorous observation is laughing-worthy.
If the observed laughs at the humorous observation than, and only than does the observer have the right away to laugh also.
If the observed thinks that the humorous observation is not humorous and doesn't laugh, the observer won’t have to worry about looking like a complete fool.
Now see, if the observed does not find the humorous observation amusing and the observer laughs, it is only proving that the observer is not a successful observer because he or she failed to observe that the observed did not find the humorous observation humorous.
